If you agree to these Terms and Conditions and/or our Privacy and Cookies Policies, you are required to create an account as an authorised account holder prior to making purchases on the Krystal Kingdom website. If you do not agree, with our Terms and Conditions and/or our Privacy and Cookies Policies, please do not create an account or use the Krystal Kingdom website.

The Krystal Kingdom website is provided free of charge for personal use only, subject to the Terms and Conditions and Privacy and Cookies Policies. By using the Krystal Kingdom website, you agree to be bound by the Terms and Conditions and Privacy and Cookies Policies.

Definitions:

General terms used in this document:

“Buyer” means the person who buys Goods and Services from the Seller and includes where the terms referred to as “you” or “your” in these Terms and Conditions  
“Consumer” shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977
“Goods” means the products listed on your order
“Order” means the products listed on your order, order confirmation email and order invoice
“Seller” means Crystal Warehouse Limited t/a Krystal Kingdom a company registered in the United Kingdom company number 07756622 whose registered address for service is Maple House 382 Kenton Road, Kenton, Harrow, Middlesex, HA3 9DP)
“Prices” means the prices of the Goods and Services maintained by the Seller as amended from time to time
“Terms and Conditions” means the terms and conditions of sale set out in this document.
“Service” means the facility of access to the Sellers website and other resource offered by the Seller in connection with the Goods  

General:

These Terms and Conditions shall apply to all contracts for the sale of Goods and Services by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.

UK law shall govern every aspect of contractual agreement concerning the purchases made from the Seller.

All Orders for shall be deemed to be an offer by the Buyer to purchase Goods and Services pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.

Acceptance of sales order confirmation of purchased shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and Conditions.

No Order will be deemed to constitute a contract of sale irrespective of the manner of its transmission to the Seller until the Order has been dispatched by the Seller. We will confirm that the Order has been dispatched by a Dispatch Confirmation email. The confirmation email amounts to an acceptance by the Seller of your offer to buy Goods and Services from us.

These Terms and Conditions are available upon request by email from the Seller or can be viewed online at www.thekrystalkingdom.co.uk/terms. The Seller reserves the right to amend the Terms and Conditions from time to time.

Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer.

Our store is hosted on Realex. they provide us with the online e-commerce payment platform that facilitates us to sell our products and services to you. Payments by you will be made through Realex.

We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Product Information:

Any description given or applied to the Goods and Services is given by way of identification only and the use of such description shall not constitute a sale by description. For avoidance of doubt, the Buyer hereby affirms that it does not in any way rely on any description when committing to the contract.

Every product offered for sale has a dedicated webpage. We aim to accurately describe every product with a written description and display each product with its representative photograph(s).

Crystal and minerals displayed for sale by the Seller are sold as seen and can often be very delicate, brittle and contain natural flaws due to their inherent nature. Crystals and minerals may also alter in colour or structure over time. Buyers should be aware of this when adding to their collections.

The Seller reserves the right to alter prices or withdraw and modify products from time to time. Products illustrated on the Seller’s website are done so as accurately as modern digital reproduction methods allow. It is the responsibility of the buyer to check the desired colour and finish before purchasing. It is also the responsibility of the Buyer to check the suitability of the product size before purchasing.

Price Fluctuation:

Precious metal, diamond, precious and semi-precious gem prices fluctuate substantially within a short span of time. Whilst we do our best to maintain prices, from time to time we may have to increase our prices. If our prices decrease after you have placed your order or after you have received your goods, you are not entitled to receive the difference back as goods have already been purchased from our manufacturers at the higher price.

Jewellery Item Description:

All sizes and weights quoted are approximate and may vary slightly in a finished item, sizes are quoted to the nearest 0.5mm. Occasionally mistakes can happen with price or product description. We are not obligated to fulfil orders for items priced incorrectly or with errors in the description or specification. Gemstones are natural materials and colours will vary, we will do our best to supply gemstones to the customers preference but variations will occur and we are limited by the materials available at the time of order.

Jewellery Product Images:

Our product images have been provided to give an example of the final product. As diamond, gemstone and metal are natural materials, they can vary in colour, shade and appearance from the product image. Photography lighting can also affect colour or shade so images will show jewellery in a brighter than normal light. Monitor settings also vary between computers. Product images are large to provide detail and do not represent the size of the actual item, pay close attention to the item’s dimensions.

Jewellery Safety Disclaimer:

Products are not recommended for children under the age of 5 years. Jewellery purchased for children should be worn under supervised conditions and all products should be stored out of the reach of toddlers. We will not take any responsibility for the use and safety of our products after purchase. This does not affect your rights in terms of replacement of faulty goods.

Guarantee on Jewellery:

All our jewellery is guaranteed against manufacturing defects for 12 months from date of delivery. Manufacturing defects may include; casting, plating or setting errors.

This guarantee does not cover damage, this may include: scratches, dents, cracks in metals (unless caused by a manufacturing error), damaged settings, broken/cracked/chipped or missing diamonds or gemstones.

Upon claiming under this guarantee we must inspect the item to establish how the issue has occurred. We may provide assessments and photographs, if possible, on request. Should the item be damaged and show no sign of a manufacturing defect then we may offer a price quote for repair, if possible, at our discretion.

Any manufacturer backed quality guarantee is not to be confused with a warranty or insurance, we recommend customers take out their own insurance policies.

It is the customer responsibility to return the goods to us via insured and tracked delivery and cover postage costs, if the issue is found to be a manufacturing defect, then you may make a claim for postage to be refunded. We will cover the costs of returning your jewellery back to you.

Disclaimer:

All healing uses, metaphysical definitions and crystal and mineral properties are provided to educate the Consumer and do not imply a guarantee of effect.  No Medical claims are made for the crystals and the information given is not intended to act as a substitute for medical treatment. Those suffering from illness should consult with a General Practitioner in the first instance.

Your Account:

The Buyer is responsible for all aspects of the account with us. After creating your account, please ensure you have received your welcome email detailing your log in details and password before placing an order with us. Please keep your password safe and do not pass it on to any third parties.

Your Account Password:

You can amend any of your account information including your name, address, email address and password by selecting My Account after logging in. If you cannot remember your password, you can request a password reset link to be sent to your registered email address by selecting Forgotten Password from the log in page.

Your Orders:

All orders placed with us can be viewed when you log in to your account. You will be notified by email of order status updates, and these can be viewed when you log in to your account.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

Acceptance of Terms and Conditions:

By Placing an order with the Seller, the Buyer is agreeing to be bound by the Sellers’ Terms and Conditions.

This does not affect your statutory rights as a Consumer.

Price and Payment:

The price of Goods and Services shall be that stipulated on the Seller’s website and contained on the Buyer’s Order at the date of Order.

All prices are displayed and payable in British Pounds (GBP) and include VAT (value added tax), where applicable.

Payment of the total purchase price (including VAT and any delivery charges) must be made in full before dispatch of the Goods.

The price payable shall be that displayed at the time of ordering.

The Seller does not endorse nor in any way guarantee the credentials or accuracy of any currency conversion application available on our website. The information supplied by currency conversion applications are provided by third parties and should only be used as a guide.  The Buyers card providers may charge additional charges if the Buyer is based internationally.

Payment is due at the time of order. Goods remain the property of the Seller until the Order is completed and paid for in full.

All payments are processed through our payment service provider Realex.

Postage Costs:

Postage costs are automatically selected by the system and added to the order when entering the Checkout.

The Seller uses courier services for delivery and delivery charges levied are in accordance with their standard rates (which are subject to change).

When entering the Checkout, please select the appropriate postal charge for your delivery address.

Free Shipping:

Free Shipping is offered to UK mainland addresses only on orders valued at £50 or more. Free Shipping will only be available to select once your basket has reached the appropriate promotional value.

When entering the Checkout, please select the Free Shipping option. Free Shipping cannot be claimed after checkout.

Delivery:

Unless otherwise agreed in writing, delivery of the Goods shall take place at the address specified by the Buyer within the timescale specified by the Seller.

We aim to dispatch orders within 24-48 hours depending on when the Buyer’s order is received.

The Seller shall not be held liable for any losses, expenses or consequential loss incurred by the Buyer or any other person or company arising whether directly or indirectly out of a failure to meet an estimated delivery date.

The Buyer will be notified by (Dispatch Confirmation) email once the order has been dispatched. This email will notify the Buyer of the Parcelforce Tracking reference number (or country equivalent). You can track delivery of your order using the Parcelforce Track-Trace system found on the Parcelforce website (or refer to country equivalent). In the unlikely event that you have not received your order after 15 working days, please contact us to let us know.

Import Duties:

If your delivery address is outside the UK, you may be subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by the Buyer. You should note that customs policies vary wildly from country to country; the Seller recommends the customer contacts their local customs office for further information. Please note that when shipping Goods internationally, you should be aware that cross-border shipments are subject to opening and inspection by customs authorities.

Missed Delivery:

If you have a missed delivery and been left a card by Parcelforce (or country equivalent), you should contact the local Parcelforce Delivery Office to arrange a re-delivery as soon as possible. Full details of Parcelforce’s Missed Delivery Policy for a missed delivery can be found on the Parcelforce website (or country equivalent).

If the Goods are returned to the Seller a re-postage fee will be charged to repost the order to the Buyer.

We are not liable for any order which is delivered to or collected by the wrong person due to the shipping address being incorrect.

Cancellation and Returns:

Upon receiving the delivery, the Buyer shall inspect the packaging for visible signs of transit damage before signing any delivery receipt document. In the event of visible signs of transit damage, the Buyer must clearly sign the Goods received as ‘damaged’ on the delivery receipt document before signing.

The Buyer shall then notify the Seller within 24 hours of receipt of delivery.

Refunds Policy:

You must contact us within 14 days of receipt of Goods if you wish to return part or all your Order.

The Consumer Contract (Information, Cancellation and Additional Charges) Regulations 2013 advises you of your rights relating to colour reproduction – Please note that we try our hardest to reproduce the colours of the Products. However, this isn’t always possible, and the colour may differ slightly.

Where Goods and Services are purchased via the internet, the Buyer has the right, in addition to any other rights, to cancel the Goods and Services and receive a refund by informing the Seller in writing or by email within 14 working days of receipt of the Goods.

Goods must be returned at the Buyer’s cost and should be adequately insured during the return journey. The Buyer shall receive a refund of all monies paid for the Goods (excluding delivery charges, if any) within 30 days of cancellation.

If you are unhappy with your Product when you received it, please contact us within 14 days of the day the Order was delivered (cooling off period), then we will gladly refund your money on receipt of the returned Product in accordance with our Returned Goods condition below.

We do not refund the postage or packing cost of returning any Product.

Faulty or damaged Products can be returned for a full refund or replacement at the discretion of the Consumer.

Refunds will be made to your credit or debit card within 14 days of receipt of goods.

Returned Goods:

Notification of damage, of wrongly shipping Goods or incomplete shipped Goods must be made within 14 days of delivery. Any claim made outside of 14 days will not be accepted.

Returned Goods must be in a resalable condition and in their original packaging. Seals should be intact where appropriate – for example cap seals on essential oil bottles.

The Buyer must obtain a proof of posting certificate (or country equivalent) from Royal Mail.

We must be able to resell Goods in as new condition. Any Goods where packaging has been damaged and therefore rendered un-resalable will not be refunded.

Damaged Returns:

The Buyer will be liable for the cost of remedying damage to returned Goods where such damage has, in the opinion of the Seller, been caused by the Goods being inadequately packaged by the Buyer.

Warranty:

The Seller warrants that the Goods will at the time of delivery correspond to the description given by the Seller.

The Seller’s failure to insist upon strict adherence to any of the Terms and Conditions with this Contract shall not be deemed a waiver of its rights within these Terms and Conditions.

Limitation of Liability:

Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury, however, the Seller shall not be liable for any direct loss or damage suffered by the Buyers howsoever caused, due to any negligence, breach of contract or otherwise, contrary to the price of the Goods.

The Seller shall not be liable under any circumstances to the Buyer or any third party for any indirect or consequential loss of profit, consequential or other economic loss suffered by the Buyer howsoever caused, due to any negligence, breach of contract, misrepresentation or otherwise.

Miscellaneous:

The Seller shall have no liability (including liability for negligence) for the acts or omissions of telecommunications service providers or for failures of, or faults in their networks and equipment.

The Seller shall have no liability in any delay in delivery of products to the extent that the delay is due to any event outside their control, including but not limited to acts of God.

No waiver by the Seller of any breach of these Terms and Conditions shall be considered as a waiver of any subsequent breach of the same or any other provision.

Anyone caught wilfully entering an erroneous or fictitious Account or Order will be prosecuted.

The Seller tracks the electronic fingerprints of every Order placed on the website to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website. We reserve the right to delete fictitious Accounts without notice.

Force Majeure:

Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.

Severance:

If any term or provision of these Terms and Conditions is held invalid, illegal, or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if the Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.

Intellectual Property and Rights of Use:

The Buyer acknowledges and agrees that all copyright, trademarks and all other intellectual property rights in all the Seller’s literature and website shall remain at all times vested in the Seller. The Buyer is permitted to use this material only as expressly authorised by the Seller.

The Buyer acknowledges and agrees that the material and content contained within the website is made available for personal non-commercial use only.

You may not permit, create, unauthorised framing of, or deep linking to, the Sellers website or the creation of derivative works thereof from any other website under your management or control.

Subject to the licence granted to you to use the website the Seller reserves all rights, Title, and interest in its Intellectual Property rights on the website.

Website Use and Links:

Access to and use of the Krystal Kingdom website are subject to these Terms and Conditions. The Buyer agrees that use of these website services is entirely at the risk of the Buyer.

By using the Seller’s website, the Buyer agrees not to attempt to undermine the website’s functionality and integrity.

The Seller’s website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and the Buyer acknowledges and agrees that the Seller is not responsible for the content or availability of any such sites.

Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

Product Reviews User Comments, Feedback and Other Submissions:

The Buyer grants the Seller a non-exclusive, royalty-free, worldwide licence to use or edit any reviews posted by the Buyer. We reserve the right to publish, edit or remove any reviews without notifying you. We only edit reviews to correct spelling errors and only remove reviews which we deem to be offensive, libellous or in other ways break English laws.

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
